Terms of Service

These Terms govern your use of BuiltRad Follow-Up and related BuiltRad Co. websites and services (the “Service”). By creating an account, purchasing a subscription, or using the Service, you agree to these Terms.

Accounts and eligibility

You must be at least 18 and authorized to act for the business using the Service. You are responsible for accurate account information, protecting your login credentials, and activity under your account.

Trial, billing, and cancellation

The Service offers a 14-day trial followed by the monthly or annual plan selected at checkout. Unless canceled before the trial ends, Stripe will charge the payment method on file and the subscription will automatically renew. You may manage or cancel the subscription through the billing page. Cancellation takes effect at the end of the current billing period. Except where required by law or expressly stated otherwise, paid fees are nonrefundable.

Use of the Service

We grant you a limited, nonexclusive, nontransferable right to use the Service for your internal business operations while your account has access. You may not misuse the Service, attempt unauthorized access, interfere with its operation, reverse engineer it, upload unlawful or malicious content, or use it to violate another person’s rights.

Your content

You own the customer, project, estimate, note, and file content you upload. You grant us a limited license to host, process, transmit, and back up that content solely to operate, secure, and support the Service. You represent that you have the necessary rights and permissions to provide it.

Drafts and customer communications

The Service prepares suggested text and email drafts but does not send customer communications automatically. You are responsible for reviewing every draft, deciding whether it is appropriate and accurate, sending it through your own applications, and complying with applicable communication and marketing laws. We do not guarantee that follow-up will win a job or produce a particular business result.

Availability and changes

We work to keep the Service available and useful, but uninterrupted or error-free operation is not guaranteed. We may improve, modify, suspend, or discontinue features. We may suspend access when reasonably necessary for security, nonpayment, suspected misuse, or legal compliance.

Disclaimer

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, noninfringement, or guaranteed results.

Limitation of liability

To the fullest extent permitted by law, BuiltRad Co. will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages. Our total liability arising from the Service will not exceed the amount you paid us for the Service during the 12 months before the event giving rise to the claim.

Termination

You may stop using the Service at any time. We may terminate access for a material violation of these Terms. Sections that by their nature should survive termination—including payment obligations, ownership, disclaimers, and liability limitations—will survive.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
