Terms of Service
Effective August 10, 2026
These Terms of Service ("Terms") govern your access to and use of the San Diego Home Project Builder and related pages operated by BuiltRad Co. ("BuiltRad," "we," "us," or "our"). By using the Service or submitting a project, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and accurate information
You must be at least 18 years old and able to enter into a binding agreement to use the Service. You agree to provide information that is accurate to the best of your knowledge, to update material errors when you notice them, and to submit only photos, plans, descriptions, and other content you have the right to provide.
2. Free homeowner tool
The San Diego Home Project Builder is a free tool for homeowners to organize project information and request a professional connection. BuiltRad does not charge homeowners to use the builder or request a connection. Free use does not mean that construction, design, materials, permitting, estimates, or any other work offered by a licensed professional will be free or available at a particular price.
Submitting a project creates no obligation to hire anyone. You may decline contact, decline an estimate, or choose not to enter into an agreement with a professional.
3. BuiltRad is the intake and referral layer
BuiltRad collects and organizes homeowner-supplied project information and may make a focused connection with a licensed local professional. BuiltRad is not a contractor, builder, electrician, roofer, landscaper, designer, engineer, architect, construction company, or project supervisor. BuiltRad does not:
- perform or supervise construction, repair, installation, design, engineering, or other project work;
- provide estimates, bids, quotes, price opinions, cost-per-square-foot calculations, or financing;
- negotiate a project’s scope, price, schedule, payment, or contract terms;
- prepare, sign, approve, or enforce a construction or home-improvement contract;
- collect homeowner construction payments, deposits, or escrow funds; or
- make a representation that a project is safe, permitted, code-compliant, structurally appropriate, or suitable for a particular property.
4. Licensed professionals
Any professional who contacts you is a separate licensed business, not an employee, agent, partner, joint venturer, or construction division of BuiltRad. The professional is solely responsible for its license status, classification, qualifications, insurance, estimates, contract, pricing, permits, work, payment practices, warranties, and legal compliance. Where contractor licensing is required, you should confirm the professional’s current California license and appropriate classification before hiring.
Any estimate, scope, agreement, payment, permitting, warranty, and construction work is handled directly between you and the professional. BuiltRad is not a party to that relationship and does not guarantee the professional’s work or conduct.
BuiltRad may have separate business or marketing arrangements with licensed professionals. Those arrangements are not part of your construction contract, do not make BuiltRad a contractor or salesperson for the project, and do not change your obligation to contract and pay any professional directly.
5. Connection authorization
By submitting a project, you authorize BuiltRad to use and share the project details and contact information you provided with a licensed local professional selected to respond to your request. That professional may contact you by phone, text, or email regarding the project. We aim to make a focused connection rather than broadcast your information to an unlimited list of companies. You may withdraw a future contact preference by telling the professional or contacting BuiltRad, although withdrawal does not undo a disclosure already made to a professional.
6. Project information and photos
Measurements, descriptions, preferences, property conditions, and photos are supplied by you and may be incomplete, approximate, outdated, or inaccurate. BuiltRad does not verify them on your behalf. The project summary and PDF are organizational handoff materials only. They are not an estimate, bid, scope of work, contract, design, engineering document, permit, safety assessment, inspection, warranty, or representation that any work is appropriate or code-compliant.
Do not upload images or files containing information you do not want shared with a responding professional. You grant BuiltRad a limited, non-exclusive permission to host, reproduce, format, and transmit the content you submit only as reasonably necessary to operate the Service, create the requested project summary, make the requested connection, protect the Service, and comply with law.
7. Safety and emergencies
The Service is not an emergency response service and does not provide safety, electrical, structural, gas, fire, medical, or other urgent advice. If you face an immediate danger, active fire, sparking, burning smell, gas leak, flooding, structural instability, or another emergency, stop using the affected system when safe to do so and contact the appropriate emergency, utility, or qualified professional service. Do not wait for a response through the project builder.
8. No guarantee of a connection or result
We do not guarantee that a professional will be available, that anyone will contact you, that the professional will be licensed or insured for every possible scope, that a project will be accepted, or that you will receive an estimate, schedule, permit, contract, financing, completed work, or particular result. BuiltRad may decline, pause, or stop routing a request at any time.
9. Acceptable use
You may not use the Service to submit false or misleading information, impersonate another person, upload unlawful or infringing content, harass or threaten a professional, probe or disrupt the Service, bypass security or rate limits, introduce malware, scrape private information, or use the Service for an unlawful purpose. We may restrict or terminate access when reasonably necessary to protect users, professionals, BuiltRad, or the Service.
10. Intellectual property
The Service, including its branding, design, text, software, and original content, belongs to BuiltRad or its licensors and is protected by applicable intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable permission to use the Service for its intended personal project-intake purpose. No ownership rights are transferred to you.
11. Third-party services and links
The Service may rely on or link to third-party services, including hosting, email delivery, file processing, analytics, or a licensed professional’s website. Third-party services are governed by their own terms and privacy policies. BuiltRad does not control and is not responsible for their availability, security, content, practices, or performance.
12. Disclaimers
To the fullest extent permitted by law, the Service is provided on an “as is” and “as available” basis. BuiltRad disclaims warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, availability, and any warranty arising from course of dealing or usage of trade. Nothing in these Terms limits rights or remedies that cannot lawfully be limited.
13. Limitation of liability
To the fullest extent permitted by law, BuiltRad and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages arising from or related to the Service, a project summary, a referral, a professional, a communication, or your decision to hire or not hire anyone. To the fullest extent permitted by law, BuiltRad’s total aggregate liability for claims arising from the Service will not exceed the greater of (a) $100 or (b) the amount you paid BuiltRad for the Service during the twelve months before the event giving rise to the claim. This limitation does not apply where prohibited by law.
14. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless BuiltRad and its owners, officers, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and reasonable attorneys’ fees arising from your misuse of the Service, your submitted content, your violation of these Terms, or your violation of another person’s rights. This obligation does not require you to indemnify a party for that party’s own fraud, willful misconduct, or liability that cannot legally be shifted.
15. Changes and termination
We may change, suspend, or discontinue the Service or any feature at any time. We may update these Terms by posting a revised version with a new effective date. If you continue using the Service after the revised effective date, you accept the revised Terms. Provisions that by their nature should survive termination will survive, including provisions concerning submitted content, disclaimers, liability, indemnification, and governing law.
16. Governing law and contact
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any proceeding relating to these Terms or the Service must be brought in a court of competent jurisdiction in San Diego County, California, unless applicable law requires a different forum. If any provision is held unenforceable, the remaining provisions will remain in effect.
